Downloaded materials

There is an ongoing activity at MIPAV development team to release
MIPAV as FOSS.  Meanwhile, this package is just a downloader and
installer for a non-free, non-redistributable tarball of MIPAV.
Bennett Landman <bennett.landman@vanderbilt.edu> has provided this
stripped tarball having acquired re-distribution permission from
MIPAV.

License terms listed below are for the materials downloaded and
installed by the user after accepting them during installation of the
package.  None of the materials shipped in the package itself is under
these non-free terms.

 SOFTWARE:

  Medical Image Processing, Analysis and Visualization ("MIPAV")
  installation package, the start-file, supporting files,
  documentation and example images are hereinafter collectively
  referred to as

 "SOFTWARE" RECIPIENT:

   An individual that downloads and uses MIPAV.

 Read the terms of Agreement carefully. RECIPIENT must agree to these
 terms to receive the SOFTWARE.

  1. The SOFTWARE is the property of the PROVIDER and is made available
  as a service to the research community. Title to the SOFTWARE shall
  remain with the PROVIDER. Nothing herein shall be deemed to
  constitute, by implication or otherwise, a grant to the RECIPIENT of
  any license or other rights under any patent, patent application, or
  other intellectual property right or interest.

  2. RECIPIENT SHALL NOT USE THE SOFTWARE FOR TREATING OR DIAGNOSING
  HUMAN SUBJECTS.

  3. RECIPIENT agrees not to license, or sell SOFTWARE.

  4. RECIPIENT agrees not to distribute the SOFTWARE to others not
  under RECIPIENT'S direct supervision without the PROVIDER's written
  consent. The RECIPIENT agrees to refer any request for the SOFTWARE
  to the PROVIDER.

  5. RECIPIENT agrees to use SOFTWARE only at RECIPIENT
  INSTITUTION. RECIPIENT agrees not to copy SOFTWARE, in whole or in
  part, except as required for use by RECIPIENT at RECIPIENT location.

  6. The RECIPIENT agrees to acknowledge the source of the SOFTWARE in
  any publications reporting use of it.

  7. The SOFTWARE is still under development and is supplied AS IS,
  without any accompanying services or improvements from PROVIDER. THE
  PROVIDER MAKES NO REPRESENTATIONS AND EXTENDS NO WARRANTIES OF ANY
  KIND, EITHER EXPRESSED OR IMPLIED. THERE ARE NO EXPRESS OR IMPLIED
  WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR
  THAT THE USE OF THE SOFTWARE WILL NOT INFRINGE ANY PATENT, TRADEMARK,
  OR OTHER PROPRIETARY RIGHTS OF THIRD PARTIES.

  8. Unless prohibited by law, RECIPIENT assumes all liability for
  claims for damages against it by third parties that may arise from
  the use of the SOFTWARE. All risk as to quality and performance of
  the SOFTWARE is with RECIPEINT. PROVIDER shall not be liable to
  RECIPIENT for damages arising out of the use or inability to use the
  SOFTWARE, including but not limited to loss of data or data being
  rendered inaccurate or losses sustained by RECIPIENT or third
  parties. However, to the extent permitted by law, the PROVIDER shall
  be liable to the RECIPIENT when the damage is caused by the gross
  negligence or willful misconduct of the PROVIDER.

  9. The RECIPIENT agrees to use the SOFTWARE in compliance with all
  applicable statutes and regulations.

  10. RECIPIENT agrees not to claim, infer, or imply endorsement by the
  U.S. Government of data or results obtained through RECIPIENT'S use
  of the SOFTWARE, or any resulting product(s) or service(s).

  11. RECIPIENT agrees not to reverse engineer, decompile, or
  disassemble the SOFTWARE, and also not to modify or extend the
  SOFTWARE without written permission from PROVIDER. RECIPIENT agrees
  to contact Matt McAuliffe at Matthew.McAuliffe@nih.gov if interested
  in modifying or extending the SOFTWARE.

  12. RECIPIENT agrees that the Agreement will be construed in
  accordance with Federal law as applied by the Federal courts in the
  District of Columbia.

 Certification of the Recipient:

  I have provided my consent to the license agreement; furthermore, I
  am aware that any false, fictitious or fraudulent statements or
  claims may subject me to criminal, civil or administrative
  penalties.
